These are the highlights of the event, which focused on the theme of innovation in the digital economy, and the role of data protection policies in the European Union. In recent years, the debate around balancing digital privacy and innovation has gained significant prominence, especially in light of the European Union’s GDPR policy implemented in 2018. The debate is expected to continue further, given the increasing rise of AI amid many barriers to innovation.

Students in Nigeria insist there is nothing worth celebrating as the country’s government continues to undermine the rule of law, persistently walking down the path of authoritarianism and dictatorship.
This Thursday, Students For Liberty’s Nigeria-based Director of Student Programs, Olumayowa Okediran, together with Tom G. Palmer, Vice President for International Programs at Atlas Network, will discuss Nigeria’s cry for good governance, true democracy, and the protection of citizens’ fundamental human rights.

The Year That Changed Everything |

2020 has brought us a wide array of feelings. In this video, we tried to capture the feelings of shock, anger, fear, disappointment, relief, and achievement that many of us have experienced this year.
Here is a snapshot of some of what we saw in 2020:
- Australia’s wildfires, which were active from June 2019-March 2020, burnt 46 million acres of land
- The death of Qasem Soleimani led to days of unnerving tension between the United States and Iran
- The impeachment trial of President Trump began and finished with his acquittal
- The completion of Brexit after years of postponement finally became a reality
- The vicious spread of COVID-19 brought upon a global shutdown and crashed markets
- Social distancing and face mask-wearing became the new normal
- The murder of George Floyd led to a global movement of Black Lives Matter protests
- The 2020 Belarusian presidential election led to a historic number of protests to call for free and fair elections

As COVID-19 began raging, people all throughout the world spent tremendous effort thinking about how fast the virus might spread, how mass infections would strain our hospitals, and how many of us might die. Politicians and experts told us that if we did nothing, COVID-19 would kill millions.

The Congressional Budget Office claims that the cost of shutting down the economy in addition to approved relief packages is around 15 trillion US dollars. But when we think of this gigantic figure and contrast it with the estimated number of deaths caused by COVID-19, we have to ask ourselves: was this the best use of funds?

We wanted to cut through the noise and hear real stories from real people all around the world, so we decided to interview 12 people, in 6 countries. The only stipulation was that they had to be willing to speak openly and honestly about their experiences during the COVID-19 pandemic.
We realized that despite the polarization around this topic, and intensity of opinions being shared, no one person really knows what’s going on. To move forward we need intellectual humility and empathy –– with a focus on our shared humanity –– especially at a time like this.

As a user of the internet, you most likely use one or more internet platforms to read the news, share status updates, or connect with your friends and acquaintances. But what made it possible in the first place?
A small part of the Communications Decency Act, called Section 230, is a short clause that enables free speech on the internet today.
Section 230 says, "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." It means that online outlets can host many kinds of content, and they would not be the legal owner of the content.
This sentence allowed big tech organizations like Wikipedia, Twitter, Facebook, and many more to exist. However, Section 230 also creates an opportunity for people from all walks of life to join the conversation on the net and start movements, build businesses, and exchange opinions.
Nevertheless, members of the right and the left have joined the call to repeal Section 230.
In this video, you will learn how Section 230 enables free speech, and why there is a movement against it. We spoke with Jennifer Huddleston, Director of Technology and Innovation Policy at the American Action Forum, who is a specialist in the topic. Special thanks to Ashkhen Kazaryan.

In the decade before the revolution, Parliament passed a series of new, unprecedented taxes on colonists to try to pay down their debt from the French & Indian War. In doing so, they were claiming powers to directly tax and control the colonies in a way they had never done before. Prof. Sarah Burns explains how this was perceived as a pattern of steady encroachment on freedom, as colonists became afraid that these increased powers would become permanent.

The term, ‘transgender,’ is used to identify an individual who associates themselves with a gender different than the gender they were assigned with at birth.
Unfortunately, transgender people still encounter equal rights issues across the United States. Some of these include access to public restrooms and locker rooms, being denied basic health care access, and being denied employment into certain career fields within the government.
The transgender-troop-ban allows the federal government to reject transgender people trying to join the military and discharge current troops in the military. Across the United States, transgender people face these issues every day from all political sides.
What is the solution to transgender violence? Do we try and change the way the state approaches trans people? Do we try to have more cultural understanding?
In 2015, Professor Deirde McCloskey joined Sarah Rose from Learn Liberty to discuss what changes need to be made in order to better foster acceptance for the transgender community.

In 2016, Harvard Professor Michael Bronski explained what led to the pivotal moment when the Supreme Court ruled that discussing homosexuality was “okay.”
Unfortunately there was actually a time when magazines with “gay or lesbian content”-- not pornographic content-- were censored by the Post Office. This era was a dark time for the LGBTQ community, when any media created by or for them could be seized.

We were thinking about free expression in gay, and lesbian people. I think one thing to focus on publications, and the media, particularly books. My name is Michael Bronski. I'm professor of the Practice of Activism and Media at Harvard University.
In the past 5 decades in England, and America, maybe other European countries there's been an enormous push against state censorship. Certainly in America right? We saw enormous Supreme Court battles that allowed books such as William Burrough's "Naked Lunch," John Cleland's erotic novel from the 1700's "Fanny Hill," Henry Miller's "Tropic of Cancer." Were all seen as being not pornographic, but not obscene which is the legal standard. Right?
Since then it opened the flood gates to any number of highly literary to highly pornographic materials out in the culture. What's interesting is that 2 things here. One thing is that when we look at the history of gay, and lesbian publishing there's always been a different standard. In 1954 there's a group called Mattachine Society. They publish a journal called "One" the homosexual magazine. Which was confiscated by the post office, by the postal officials.

One magazine fought this, and in 1958, so it took 4 years to get to the lower courts. 1958 it went to the Supreme Court in a case called One versus Olesen. In which the Supreme Court ruled that in fact homosexual material in, and of itself was not pornographic. The Supreme Court at that point would have held that if in fact it was images of naked people having sex that it would have been pornographic. Gay, and lesbian content in and of itself was not pornographic.
Since that time, certainly by the later 60's, the market was flooded by heterosexual pornography, straight pornography, novels that discussed homosexual, and heterosexual. By the later 60's, because of the Supreme Court rulings from the late 50's early 60's, we had culturally people were publishing literary novels, pornographic novels, pornographic pictures. All of which were protected under the first amendment.
One could argue, I think it's true, that in fact for the homosexual material part of the key for that was One inc. versus Olsen lawsuit from 1958. That said that any homosexual content by itself is not obscene. We all know that you can rent porno movies on TV now. You can get any number of books. Best selling novels often have highly erotic, and explicitly graphic content. It's all protected.
When we look at all these Supreme Court decisions, and I'm thinking of the ones about Fanny Hill, and Naked Lunch, and things just before this comes this important decision which is One Inc. V. Olesen. Based on the fact that One magazine, quote One the homosexual magazine, was seized by the post office, and was actually deemed as being pornographic. Simply because it had gay, and lesbian content in it.
the real importance, I think, of One Inc. V. Olesen is that it really comes in the beginning of these other censorship things. It really sets the tone saying that content per se, before you get to it being overly sexual or being too graphic, content per se should not be censored. I think for gay, and lesbian people, but I think for the entire censorship battle.
That One Inc, V. Olesen is this pivotal moment in which the Supreme Court says that discussing homosexuality in and of itself is fine. What that meant is that on some level the simple discussion made homosexuality okay, because it was able to be discussed.

If a woman walked down the street in the 1950’s wearing men’s shoes, pants, a fedora, and a wristwatch, she could be arrested, fined, or even put in jail. Why? Because her attire violated “Three-Piece Laws,” which in many states forbade men and women from wearing more than three articles of clothing associated with the opposite sex.
In 2016, Professor Michael Bronski explained the history behind these laws and others which aimed to punish the LGBTQ+ community.

Freedom of expression has to be the freedom to express yourself through dress, through department, through speech, through public activity, the way that you want to. The notion that you have to not be appropriate to that gender is really about a few people, but people should have a right to do it. People should have the right to act, look, and dress whichever way that they want to.
My name's Michael Bronski. I'm Professor of the Practice of Activism and Media at Harvard University. Many states, and George Chauncey writes about this very well in his book "Gay New York" about New York City, had laws that were called the Three-Piece Laws. Which simply said that any man or woman, as defined as man or woman under the law in the most traditional ways, were forbidden to wear more than three articles of clothing or accessories that belonged to the so-called opposite sex.
What it would mean is that, if a lesbian, say in the '50s or really early '60s, was wearing sensible men's shoes, a pair of pants, that could have been women's pants, not even men's pants, but they were pants, they were not a dress. A men's tailored shirt, and say a man's fedora, or a men's wristwatch, which would bring her up to four pieces of masculine clothing, she could be arrested. She could be fined. She could even be put in jail for a period of time.
There's a law in New York State, other states have it, where you could not serve an open homosexual a drink. These came out of prohibition to essentially crackdown on gay bars, where presumably everybody in the bar would be openly homosexual. There were laws that are targeted at gay and lesbian people, and I think that the Three-Piece Law was totally aimed at gay men and at lesbians. These laws came out of social sentiment that you shouldn't do this. The laws actually emerge from social conditions. Any social justice or civil rights movement has to deal with the law.
There are so many laws that need to be changed. It's not a surprise that people become overly litigious. People become overly focused on changing laws. People set goals, either big goals or small goals, based upon the law. This is all really important. I think that on some level if we're looking at the sanctity of the human being connected to the first amendment, but also going beyond that, looking at a notion of how we can respect people. That changing hearts and minds ultimately will do more than changing the law. Changing hearts and minds will actually change the laws that are bad.

Racial Inequality in the Criminal Justice System |

In this 2010 video, Prof. Daniel D'Amico argues that one of the reasons why minorities are grossly overrepresented in U.S. prisons may lie with the criminal justice system itself. Laws about drug prohibition, for example, are supposed to be color blind. But people with different levels of wealth face different costs and benefits to participating in the drug trade.

In light of current events, we republished this as it became relevant again. To provide the audience with context, Prof. D'Amico added the following:
This video was not meant to be a full explanation, but rather a touchstone for people engaged with such topics, often informal online courses, to all get on the same page regarding basic facts. The description rather than diagnosis was the primary purpose.
The video doesn’t control for the incidence of crime, as this was meant to be presented alongside other materials and moderated conversations. Criminal incidence is a huge factor in explaining the racial gaps in police use of force, arrests, and convictions. In many of these arenas, public discourse may over emphasizes racial prejudice as a driving cause. However, the disparity in prison sentencing is basically the one area where such does not get fully reduced by reasonable controls. I stand by the thrust of the video. Prison populations are racially unequal (not necessarily unfair and not necessarily unjust though not necessarily just and not necessarily fair either) relative to the general population. Why is that worth pointing out (regardless of controlling for criminal incidence)? Here's a number of "if-then" statements that at the time of production were in my mind's eye, to serve as conversational starters.
1. Imprisonment is a unique form of punishment apart from fines, restitution, house arrest, community service. It’s designed to deprive individuals of liberty, perhaps rightly so in the context of violent crime. However, imprisonment may carry unique externalities upon communities beyond the costs that it imposes on inmates. Prisons are a tax liability. If citizens want to promote fiscal sustainability it may be worth investigating alternatives with lower fiscal burdens.
2. Cultural norms and family stability are probably relevant to criminal behavior. If true, imprisonment may exaggerate rather than mitigate these issues. Gender ratios of the 18-35 year age bracket in the black community are heavily skewed by imprisonment, perhaps making upcoming cohorts difficult to deter from crime. If one is concerned about promoting wellbeing and prosperity in the black community, imprisonment may pose unique challenges.
3. The point that the criminal justice system has the inevitable potential for inequities I stand by, this is not necessarily proof of injustice or unfairness per se. One way to interpret this, rather than a puzzle to be explained, is that it may explain why different racial groups perceive the fairness conditions of the CJ system so differently. I'm not a philosopher, these videos were meant to inspire philosophical conversations not definitively prove them. If a free society demands equal treatment under the law and the consent of the governed, then imprisonment poses challenges in so far as it may cultivate a perception of unfairness.
This idea that criminal enforcement has an inevitable potential for inequity (not the same thing as institutionalized racism though not incompatible with the concept either) is a longstanding part of classical liberalism. Laws that impose prohibitions apart from violating others' persons or property, require unequal enforcements. Prohibiting drugs harms drug users more than those who abstain. This is similar to how new regulations impose costs on new entrants to an industry and benefit existing businesses even if framed as universal policies. Latent differences across races performing prohibited behaviors will be reflected in CJ system.
The more complex the criminal code, the more opportunities there are for explicit bias. If we lower the speed limit to 25 miles an hour, everyone becomes a criminal, and we afford police officers the discretion to enforce laws as they chose. In so far as some officers may be prejudiced, there are more opportunities for prejudice with larger and more bureaucratized CJ systems.
Mass imprisonment, overcriminalization, police militarization, and excessive force are all points of concern for those who value liberty. These issues may be impeded by overly focusing on race, but I support those groups motivated by racial solidarity who successfully shine light upon their realities.

Geanluca Lorenzon is Director of Debureacratization in the Ministry of Economy in Brazil. Previously, he was a consultant at McKinsey & Company and also the Chief Operating Officer at Mises Brasil.
As a student, Geanluca was heavily involved in Students For Liberty and ran the Clube Farroupilha group, which was dedicated to spreading the ideals of classical liberalism in Brazil.
In 2019, the Brazilian Congress passed the Economic Freedom Bill, which determines the framework for entrepreneurs to develop their businesses, which was created by Lorenzon. In this interview, he explains the reasoning behind it and the impacts it will have on the Brazilian economy.

The War on Drugs paved the way for the United States to lay a domestic foundation for a massive and overwhelming system of oppression.
Launched in the United States by former President Richard Nixon in 1971, drug criminalization served as the catalyst for firing an international crusade, strong-arming other countries into criminalizing cannabis whether they wanted to or not.

AARON: Why don't I participate in the legal market? Um, I do not agree with how the legal market is set up in the very beginning from the word go. It was never set up to address who it used to harm and who it still harms to this day.
TIM: I quickly learned that simple word legalization was a lot more complicated than I first thought. For most of human history, cannabis was legal and widely used across the world until the early 1900's when something started to go very wrong.
TIM: America's top prohibition cop, Harry Anslinger was named the head of the newly formed federal Bureau of narcotics.
TIM: With alcohol re-legalized, there weren't many bootleggers or speakeasies to go after. Cocaine and heroin didn't have enough users, so worried he'd be out of a job. Harry was looking to invent a new public enemy, an enemy that would give him an excuse to go after the two groups he hated the most. Addicts and ethnic minorities. In 1937 in the spirit of paternalistic alcohol prohibition, he invented a ban on what he dubbed marijuana.
TIM: Talk to me about the war on drugs (...). What does that mean to you?
AARON: War on drugs is a war on black men.
TIM: Legalization came with some strings attached, stopping the victims of the war on drugs from gaining entry into the newly formed marketplace. Written right into cannabis legislation. The war on drugs, wages on.
AARON: The first thing the state of Washington did was, you couldn't have a felony. Felony is code word for, if this was Jim Crow, no blacks allowed. You couldn't be married to a person with a felony. So then when could anybody in the black community get in? Because again, massive effects of the war on drugs. Then let's get past that part.
AARON: It was capital. You had to go through an IRS background check fingerprinting and they wanted to know where your money was. Well, who black, wasn't gonna get over scrutinized, right? Third one was land. There's no land for anybody to open up a business. We don't have uncles and aunts with lands, right? Like that doesn't exist because of red lining because of the systems that were set up in place. Right? So, okay. Felonies, which we know were created through policy, capital, which, you know, access to capital is controlled through policy. And then, land, which we know which controlled through policy. Let's pump the brakes on the three that we can see off top and go to the trauma. You were just chasing me down with SWAT gear, helicopters, tanks. But now you're telling me "Oh no, no, go ahead. You're good. You can get into the legal cannabis again." Who believes that, right?
TIM: The war on drugs never really was a war on drugs. It was always a war on people.
AARON: Legislation and policy created this situation. Legislation and policy has to fix this situation.
TIM: We can advocate for a fair system that ends the harmful ramifications of the war on drugs. That change starts with you. We have to remove the stigma around pot consumption, sales and cultivation.

The War on Drugs is the government’s name for coercive and often violent efforts to prevent the consumption of certain arbitrarily proscribed intoxicants. But since drugs are not animate and cannot act on their own, this war is really a war on people: people who want to use the psychoactive substances that the government has decided to ban, and people who help them do that.
The War on Drugs officially aims to reduce the harm caused by substance abuse, but it causes a lot of harm on its own. While potential drug abusers who are deterred by prohibition may be better off than they otherwise would be, people who defy prohibition are decidedly worse off, and so is the general public, which suffers from the side effects of the attempt to dictate which chemicals people may swallow, snort, smoke, or inject.
Even nonviolent drug offenders can be sent to prison for years or decades because of conduct that violates no one’s rights, such as growing marijuana or selling cocaine. That policy not only punishes drug offenders, but hurts their families and communities while costing taxpayers money that might otherwise be used to fight predatory crime.
In addition to the risk of arrest and jail, drug users face the danger of violence in a black market where there are no legal, peaceful methods for resolving disputes. They also find that the quality and potency of illegal drugs are uncertain and unpredictable.
The tendency of drug traffickers to favor more potent drugs, which contain more doses in any given volume, helps explain the shift from beer and wine to distilled spirits during alcohol prohibition, the shift from opium to heroin after nonmedical use of narcotics was banned, and the more recent shift from heroin to fentanyl. The artificially high prices of illegal drugs, meanwhile, encourage users to get more bang for their buck by injecting drugs, which opens the door to soft-tissue infections and transmission of blood-borne diseases such as hepatitis and AIDS, especially when legal restrictions make clean needles hard to get.
Those artificially high prices also make it more likely that heavy drug users will support their habits by theft, which has a spillover effect on the general population. So does the violence associated with the black market. Criminal organizations use murder to grab territory and retaliate against competitors, sometimes killing bystanders in the process. The “risk premium” that can be earned by supplying illegal drugs enriches and empowers these gangs, leading to carnage, disorder, and rampant corruption in countries such as Mexico and Honduras.
The War on Drugs, in short, imposes heavy burdens on identifiable victims, including drug users, drug suppliers, bystanders caught in the crossfire, and anyone who values his privacy or wants to carry cash without worrying that it will be legally stolen by police. It imposes these burdens for the sake of hypothetical people who might otherwise suffer as a result of their own drug abuse. Whether that tradeoff can be justified in strictly utilitarian terms is doubtful, and it is impossible to square with any moral theory that recognizes individuals as sovereign over their own minds and bodies.

However, some drugmaker lobbyists have argued that pressuring drugmakers to pool their resources will do little to beat the clock. Should drugmakers give up their rights in a pandemic? Find his answer to this at the 29:51 minute mark.

I do worry that moving to a regime with no intellectual property rights could have some negative consequences, particularly in pharmaceuticals, which are fairly easy to reverse engineer.
You just run through chemical analysis of what’s in the pill, and then you can reproduce it, and the marginal costs are very low because you didn’t have all of that overhead and research, and it could be that we would suffer a drying up of new pharmaceutical compounds and cures.
So that’s something that makes me hesitant about saying ‘just abolish it all.’ It’s a utilitarian concern.

How would you introduce yourself to someone who doesn’t know you at all?
TP: My name is Tom Palmer and I’ve been working for liberty for a long time. It’s my passion, it’s what I do, it’s what I think about when I wake up in the morning, and when I go to bed at night.
What does a day in your life look like?

I get to meet really inspiring people who are working for freedom in so many different contexts, under totalitarianism or authoritarianism governments, under much freer societies all across the world, every religion, every race of humans, every ethnicity, and that love of freedom is present in all of them.
What do you think about the journey of libertarianism all around the globe?
The liberty movement is better equipped, better prepared, and better connected than at any time in human history. At the same time, we see threats on the horizon: the reemergence of forms of collectivism, of national socialism, of fascism, in various guises, reemerging around the world, and then the emergence of several states that are actively hostile to libertarian or classical liberal ideas.
What topics do you predict will no longer be discussed in 10 years?
It is my hope, not my prediction, that the utter stupidity and ignorance of protectionism will be effectively refuted in practice and in discourse.
What’s your advice to young leaders who aspire to be as influential as you?
More influential than me, that’s the number one thing. One of the reasons why I’m such a strong supporter of Students For Liberty is because I want them to do a better job than my generation has done, and I trust and believe that they will.
In order to do that, it means becoming more knowledgeable - that self-cultivation. Learn more, read more, read widely, and read the ideas of anti-libertarians. Understand their arguments and have an open mind.

Tom Palmer: I would say that the liberty movement is better equipped, better prepared, and better connected than at any time in human history. So I’m very optimistic about that. At the same time, we see threats on the horizon we didn’t see in the past.
The reemergence of forms of collectivism that we thought were dead in 1945, national socialism, of fascism, and various guises reemerging around the world, and then the emergence of several states that are actively hostile to libertarian or classical liberal ideas.
Certainly the Kremlin, certainly in Beijing, and you could list some others as well that are combating libertarianism and they see our views as the enemy. And any kind of illiberalism, left-wing, right-wing, they don’t care, is preferable to freedom.
So that’s something we haven’t seen since the end of the Cold War. They’ve just begun to emerge now in a very strong way. And finally a threat that I don’t think we’ve really come to grips with yet of a new kind of totalitarian state that makes the ideas of George Orwell seem modest and humble.
The total surveillance state that is being pioneered in Beijing led by the communist party leadership, has complete surveillance of everything. Your electronic life, your physical life in the world, where you go, facial recognition technology, artificial intelligence, cameras everywhere that can recognize not just your face, but how you walk, and then the social credit system, which will create a reign of micro incentives, negative and positive, to mold the population, to be subservient, to be obedient slaves of the state.
I think this is really quite scary, and we need to be prepared to respond to that, and to defend liberty against the new kind of enemy that is using technologies that were undreamt of even 25 or 30 years ago.
